Council Approval in Sydney — What You Need to Know

Most Sydney parents are surprised to find out how straightforward this is. Under the NSW State Environmental Planning Policy (Exempt and Complying Development Codes), a cubby house is classified as exempt development in most residential zones — meaning no council approval needed, no paperwork, no waiting.

To qualify as exempt development in NSW, your cubby house generally needs to meet these criteria:

  • Floor area no more than 10m² — all our models are well under this
  • Wall height no more than 2.4m above ground level
  • Ridge height no more than 3m above ground level
  • At least 900mm from any boundary fence
  • Property is not heritage listed or in a heritage conservation area

These rules apply across most Sydney councils including City of Sydney, Parramatta, Blacktown, Hills Shire, Hornsby, Northern Beaches, Randwick, Sutherland Shire, Liverpool and Penrith. Setting Up in a Sydney Backyard

Sydney's clay soils and heavy summer rain mean one thing matters more than anything else before your cubby arrives: a solid, level base. We recommend hardwood sleepers or treated pine decking boards on compacted ground. Avoid placing directly on soil, pavers or grass — moisture wicking up from underneath will shorten the life of any timber structure significantly.

Painting your cubby house

All our cubby houses arrive in raw timber and need painting before or during assembly — this is essential, not optional. Sydney's climate is demanding: hot summers, humidity along the coast, and sustained rainfall in autumn and winter. Two coats of quality exterior water-based paint before the first wet season will protect the timber for years. Touch up horizontal surfaces annually and your cubby will last well into your kids' secondary school years.

Which size suits your yard?

Sydney backyards vary a lot. A compact inner-west terrace and a Hills District quarter-acre are very different problems. As a rough guide: if you're working with under 50m², the Arlo Cubby House is a compact, ground-level option that doesn't dominate the space. For medium to large yards, our elevated designs like the Millie, Frankie Grand, or Billie Grand create usable space underneath while giving kids a proper fort experience. No — all our cubby houses arrive flat-packed via freight carrier. Assembly takes two adults roughly 2–4 hours depending on the model. All hardware and step-by-step instructions are included. Most families make a weekend of it.

What if something arrives damaged?

Contact us within 48 hours of delivery with photos and we'll sort it out. This is rare, but we take it seriously and will arrange replacement parts or an appropriate resolution under our warranty.

Can I add a swing set or mud kitchen later?
